I. INFORMATION ABOUT THE LSSI (Ley de Servicios de la Sociedad de la Información [Law on Information Society Services and Electronic Commerce])
In compliance with the provisions of Law 34/2002, of July 11, on information society services and e-commerce, it is made known that the owner of the website www.iberostar.com (the Website) is PORTAL INTERACTIV, S.L. Single Shareholder Company, with registered address at C/ General Riera, 154, 07010 Palma de Mallorca, Spain and CIF B38803953, registered in the Commercial Register of Mallorca, in volume 2699, folio 120, page PM-80935, Travel Agency of the Wholesale-Retail Group which holds Title-License code AVBAL/718, granted by the Tourism Council of the Autonomous Government of the Balearic Islands in accordance with the provisions of the Regulations on Travel Agencies from said Autonomous Community and other applicable regulations (hereinafter, PORTAL INTERACTIV).
The following entities are contracted when a customer books and enjoys a stay in Iberostar hotels through the Website, depending on the geographic location affected by the booking:
- Hotels located in Europe and Africa: PORTAL INTERACTIV.
- Hotels located in the Americas and the Caribbean, except Cuba and the hotels indicated below: VISIT US, Inc., with registered address at 9250 NW 36th ST. Doral FL 33178, Miami, USA (hereinafter, VISIT US).
- When a customer books and enjoys a stay in the hotel Iberostar Selection Miraflores, located at the intersection of Avenida Malecón 28 de Julio N° 385 and Calle Manco Capac N° 121, district of Miraflores, province and department of Lima, Peru, the commercial entity INMOBILIARIA SELAYA, S.A.C., with registered address at Calle Amador Merino Reyna Nº 339 (oficina 1501), San Isidro, Lima, Peru and RUC (Registro Único de Contribuyentes [Tax ID Number]) 20601100941 is contracted.
- When a customer books and enjoys a stay in the hotel Iberostar 70 Park Avenue, located at 70 Park Avenue (Cross Street Park Avenue and 38th Street), New York, NY ZIP code: 10016, USA, the commercial entity CITUSA Hotels, LLC, with registered address at CT Corporation System, 111 8th Avenue, New York, NY 10011, USA and EIN (Employer Identification Number) 38-4001452 will be contracted.

II. PRIVACY
This website and app feature functions that may imply the handling of your personal data. This is the case of the chat function, in particular, the purpose of which is to answer questions and respond to requests, as well as Claims and Complaints, with the goal of addressing any incidents or complaints you may have during your stay. Please note that doing so may involve handling the personal data that you have provide us. If you attach a document or image via the app, we will ask for your permission before accessing your device’s photo gallery and/or camera. Your data will be handled in accordance with the provisions of the current regulations, as well as the terms of the Privacy Policy, which you can consult here.
III. TERMS AND CONDITIONS OF USE
These general terms and conditions of use regulate the access and use of the various contents and services included or accessible through the website www.iberostar.com (hereinafter, the Website).
Through the Website, the user is provided with information regarding stays at hotels belonging to Iberostar Group, including information pertaining to room availability, rates, searching for hotels by geographical location and the location of hotels based on rate.
These general terms and conditions must be understood without prejudice to the particular booking conditions shown on the Website.
You acquire the status of user simply by using the Website. The use of the Website and any of its services means that, as a user, you accept each and every one of the present general terms and conditions without reservations, as well as the specific terms and conditions that, if applicable, regulate the use of the Website or related services connected thereto.
The owners of the Website may, at any time and without prior notice, modify the presentation and configuration of the Website, as well as these general terms and conditions, and introduce new terms and conditions of use. These modifications will be published on the Website so that the user is aware of them before proceeding to use it. Using the Website once the general terms and conditions have been modified means that the user accepts these modified general terms and conditions.
User obligations
By using the Website, the user declares to be over 18 years of age. To use the Website, minors must obtain prior permission from their parents, guardians, or legal representatives, who will be held responsible for all actions carried out by the minors under their care.
The user agrees to use the Website and the services related thereto in a diligent manner that complies with the law, ethics, and public order, along with these general terms and conditions and particular terms that may apply. (b) Do not use false identities or impersonate the identity of others when using the Website or any of the services linked thereto, including the use, where appropriate, of passwords or access codes of third parties, or in any other way.
(c) Do not hide or falsify, in any way, the source of email messages, intercept, delete, or modify other users’ email messages, or send mass email messages.
(d) Do not destroy, alter, disable, or damage the data, information, programs, or electronic documents belonging to the owners of the Website, their suppliers, or third parties.
(e) Do not use the contents and, in particular, the information obtained through the Website to send out publicity, to send messages for marketing purposes or any other type of commercial purpose, or to collect or store personal data from third parties.
(f) Do not introduce or spread any information that is defamatory, slanderous, obscene, threatening, xenophobic, that incites violence, that incites discrimination due to sex, race, ideology, or religion or that in any way violates ethics, the public order, fundamental rights, public liberties, honor, privacy, or the image of third parties and current regulations in general.

Intellectual and industrial property
The user recognizes that all of the elements of the Website and of each of the services provided through it, the information and materials contained therein, the structure, selection, ordering, and presentation of its contents, and the computer programs used in connection therewith, are protected by intellectual and industrial property rights of the owners of the Website or third parties, as appropriate.
Unless authorized by the owners of the Website or, where appropriate, by third-party owners of the relevant rights, or unless legally permitted, the user may not reproduce, transform, modify, disassemble, perform reverse engineering, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph. In no event shall it be understood that any license is granted or a waiver, transmission, or a total or partial transfer of such rights is made, nor is any right or lawful expectation particularly provided to carry out any alteration, exploitation, reproduction, distribution or public communication of such content without the prior, express authorization of the Website or its corresponding owners.

Passwords

Similarly, they do not control and do not guarantee the absence of viruses or other harmful elements in the content or services provided or given by third parties through the Website.
The owners of the Website do not guarantee the technical availability, quality, reliability, accuracy, or veracity of the contents and services available on websites owned by or managed by third parties which the user can access through technical linking devices (“links”) from the Website. The owners of the Website do not control the content of the aforementioned websites, nor do they offer or sell the products and services available on the linked websites, nor do they assume any responsibility therefor.
The Website will be used at the user’s own risk. Thus, the owners of the Website are not liable for: possible damages arising from interference, interruption, computer viruses, telephone breakdowns or telephone disconnections not caused by the Website; delays or blockages in the use of this electronic system caused by deficiencies or overloads in its data processing center, telephone lines, in the internet system, or other electrical systems; nor any other alteration that may occur in users’ Software or Hardware.
Similarly, the owners of the Website will not be liable for damages caused by third parties through illegitimate interference beyond their control. Nor will they be liable for any damages or harm caused by the use or misuse of the content of the Website or for the consequences that may arise from errors, defects, or omissions in the content provided by third parties that may appear on it. For these purposes, the chosen Hotel is the third party.
Termination
Without prejudice to liability for damages and harm that may arise, the owners of the Website may, immediately and without prior notice, terminate their relationship with the user, interrupting access to the Website or its corresponding services, if it identifies any use thereof or of any of the services related thereto that is contrary to the applicable general or specific conditions.
The user will be liable for damages or harm of any nature that the owners of the Website or any of its subsidiaries may suffer, directly or indirectly, as a consequence of failing to comply with any of the obligations stemming from the general or specific conditions in connection with the use of the Website or any of the services linked thereto. Similarly, the user will hold the owners of the Website harmless from any sanctions, claims, or lawsuits that may be filed by a third party, including any public bodies, against the owners of the Website, its employees, or its agents, as a result of a violation of any third-party rights by said user through the use of the Website or the services linked thereto in a manner contrary to what is stated in the applicable general or specific conditions.
Applicable law and jurisdiction
These general terms and conditions are governed by Spanish law. The owners of the Website and the user, expressly waiving any other jurisdiction, are subject to the Courts and Tribunals of the user’s registered address for any dispute that may arise from the use of the Website or the services linked thereto.
In the event that the user is domiciled outside Spain, the owners of the Website and the user submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Palma de Mallorca (Spain).
